Vivid Seats sold us two tickets for the March 31 Bruce Springsteen concert in San Francisco, with added fees nearly equal to the price of the tickets, then failed to deliver the tickets we'd purchased. We spent an entire day talking to their customer service people, who kept trying to get in touch with the seller but, by the time the show started, we still did not have our tickets. Not only did we not get to see the show we had been looking forward to seeing, but they refused to even refund the nearly $500 they had taken from us, saying that, unless the show itself was cancelled, their policy did not permit refunds.Upon edit: Order no. 6286615According to Vivid Seats, seller transferred the tickets, yet, when we went to collect the tickets, we repeatedly received messages that the seller had cancelled the transfer and there were no tickets for us to collect. After many attempts to collect them, we started getting messages from Ticketmaster to "Please try again, there was an unexpected error while processing your request." Throughout many infuriating hours of interacting with Vivid Seats' customer service bots and occasional live representatives, Vivid Seats insisted that, because they had received proof of the initial transfer - that the seller had subsequently cancelled - the matter was closed as far as they were concerned. When shown screenshots of the cancellation and error messages on Ticketmaster, Vivid Seats kept repeating their stock phrase that the seller had transferred the tickets, so it wasn't their problem and suggested that we purchase a new smartphone and try that. When we were down to less than two hours before the concert began and still had no tickets, we informed Vivid Seats that we wished to cancel the order, since it would no longer be possible for us to reach the venue in time. Vivid Seats replied that their commitment was to the seller, who, by furnishing proof of a transfer that was subsequently cancelled by the seller, had fulfilled their end of the bargain and Viivid Seats bore no responsibility for any subsequent problems. Refunds were available, they said, only when the event itself was cancelled. When we sought information on how to initiate a dispute process, we were told that we had accepted the Terms & Conditions of their exhaustive, voluminous contract of adhesion that, typically, obliterates any and all consumer rights and any and all transparency and accountability for Vivid Seats, so we had no recourse. When we asked to whom else we could speak, we were informed that they did not possess that information and could provide no additional assistance, we were just out several hundred dollars, the end, have a nice day.Between Vivid Seats, Ticketmaster, the seller, and us, there are enough actors involved in this process that I have no idea what went wrong where when. I'm not a software design engineer, I don't know the steps others did or did not take - I'm a consumer, it's not my job to understand and oversee every step of Vivid Seat's procedure. What I DO know is that Vivid Seats accepted staggering sums of money in fees from us, and probably from the seller as well, purportedly to facilitate a transaction between the seller and ourselves and - according to their evidently hollow and meaningless "100% Buyer Guarantee" - ensure its successful completion. Vivid Seats failed to perform that duty and then refused to accept any responsibility whatsoever for their non-performance of the contract. It is a foundational principle in contract law worldwide throughout history that a contract without consideration, i.e., something received in exchange for something given, is invalid. Vivid Seats took our money and in return provided nothing, neither "goods", i.e., tickets, nor "services", i.e., facilitation and assumption of responsibility for the transfer. What consideration then has Vivid Seats contributed to make the contract valid? If Vivid Seats assumes no responsibility for fulfillment of its contracts, why should anyone do business with you?
